Module 2

When might an employer consider terminating an employee’s employment?

This component identifies the various situations in which an employer may consider terminating an employee’s employment including:

  • misconduct;
  • unsatisfactory performance;
  • redundancy; and
  • illness or injury.

What are the legal risks in terminating an employee’s employment?

This component considers the legal risks associated with termination of employment, including:

  • unfair dismissal;
  • general protections claims;
  • breach of contract claims;
  • discrimination claims; and
  • unlawful termination claims.

We also consider the likelihood of legal action.

Module 4

How do I approach terminating an employee’s employment?

This component provides an overview of the ways termination of employment is effected by an employer, including:

  • termination on notice;
  • termination without notice (summary dismissal); and
  • termination by mutual agreement or negotiated separation.

It also explores practical matters that an employer should consider in effecting the termination of an employee’s employment, in order to best protect their business.

Module 5

Resignation: special issues for consideration

In this component we will identify some of the risks and issues that may arise for an employer when an employee resigns from their employment, including:

  • ‘forced’ resignation and its consequences; and
  • retracting resignations.

What can I do to manage the risks?

In this component we will identify a number of tips for managing the key risks associated with terminating an employee’s employment.
