Course Overview

This course will enable you to:

  • identify the legal framework regarding workplace bullying, discrimination, and sexual harassment;
  • understand key concepts such as direct and indirect discrimination and reasonable management action;
  • recognise the obligations of employers and employees for such conduct, and with the legal risks associated with these types of behaviour; and
  • understand how complaints are made and the legal process.

Course Content

Module1

Unlawful discrimination

In this component, we will look at:

  • the range of characteristics that are protected under discrimination law;
  • the difference between “direct” and “indirect” discrimination;
  • disability discrimination;
  • sex discrimination; and
  • other key areas and grey areas.

This component finishes with an overview of the legal processes involved in a claim of unlawful discrimination.

Module 2

Sexual harassment

In this component, we will look at:

  • the definition of sexual harassment;
  • common types of conduct which may constitute sexual harassment;
  • employer’s liability for sexual harassment;
  • harassment by clients and customers;
  • preventative measures for employers; and
  • being sued for sexual harassment.
Module 3

Workplace bullying

In this component we consider the following:

  • the definition of workplace bullying and the development of workplace bullying laws;
  • types of workplace behaviour that is not bullying, including reasonable management action;
  • the obligations of employers and employees with respect to bullying;
  • the role of the Fair Work Commission in handling bullying complaints; and
  • other legal issues including types of claims and online bullying.
Module 4

Preventing and responding to unacceptable behaviour

In this component we look at:

  • setting standards of behaviour;
  • creating a safe system of work; and
  • responding to reports and complaints.

Completion of the course requires a licence, which is issued upon registration and payment.
