Litigation

It is rare that we encourage our clients to litigate matters. We do, however, recognise that sometimes certain matters can only be resolved through the formal court and tribunal system. Our areas of litigation expertise include:

• defending underpayment claims;
• defence of unfair dismissal claims;
• defending adverse action claims;
• appearing in Fair Work Australia around bargaining disputation, right of entry issues and dealing with industrial action;
• defending breach of contract claims in the District Court;
• defending trade practices claims in an employment context in the Federal Court;
• Supreme Court litigation around injunctive relief (for example arising from the departure or proposed departure of key employees); and
• defending discrimination or harassment claims in the Australian Human Rights Commission or a state tribunal.
